Going-Out-of-Business Sale License and Promoter Registration

Licensee Registration

Each business desiring to conduct a going-out-of-business sale must apply for a license at least five days prior to the opening date of such sale. A license fee of one hundred dollars and a deposit of five hundred to five thousand dollars shall accompany each application.

A Going-out-of-business-sale means any sale advertised, represented, or held forth as a sale to dispose of all goods as a means of ceasing to do business or changing business location.

How to Apply for a License

Pay the license fee and deposit and provide the registration application form, with requested information, online or by mail.

License Fee and Deposit

The License Fee is $100.00.

The Deposit is either $500.00 or a dollar amount equal to 1% of the wholesale cost of the inventory, whichever amount is greater. No deposit shall exceed $5,000.00.

The deposit may be refundable. First, the license must be returned to the Consumer Protection Section upon its expiration, voluntary surrender prior to expiration, or the lapse of a granted extension. The deposit will be held by the Consumer Protection Section for at least a period of sixty days from the date of delivery of the returned license. The Consumer Protection Section will return the deposit or a portion of it after satisfying all claims that might be made upon the licensee's deposit.

Electronic Payment of Fees: License fee(s) and deposit may be paid electronically at http://www.paystar.co. Discover, Visa, and Master Card are accepted. A nonrefundable online service fee in the amount of $1.00 plus 2.75% will be charged to the credit/debit card for registrants who choose to pay fee(s) and deposit electronically.

Payments by mail: If registrants prefer, they may pay the required license fee(s) and deposit by check, without incurring an online service fee. Checks should be made payable to the “Louisiana Department of Justice” and mailed to the address listed below.

Promoter Registration

Any person desiring to act as a promoter for a going-out-of-business sale must apply for registration as a promoter and pay a registration fee of one hundred dollars. Registration will be valid for one year from the date of issuance and may be annually renewed upon application and payment of a renewal fee of one hundred dollars.

A promoter is a person who performs or offers to perform any service to facilitate or assist in a going-out-of-business sale, including but not limited to advertising and sales.
